Terms of Service

Effective: March 4, 2026

1. Acceptance

By accessing or using BrainstormRouter (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Nature of the Service

BrainstormRouter is a free AI research project operated by an individual developer. It is not a commercial product and is not backed by any company, corporation, or legal entity. The Service is provided on a best-effort basis with no guarantees of availability, performance, or continuity.

3. BYOK (Bring Your Own Key)

BrainstormRouter operates on a BYOK model. You provide your own API keys from third-party AI providers (e.g., OpenAI, Anthropic, Google). You are solely responsible for:

• Maintaining valid API keys with your chosen providers
• All costs charged by those providers for API usage
• Complying with each provider’s terms of service

BrainstormRouter does not mark up, bill for, or otherwise monetize your provider API usage. Token costs are billed directly by your providers.

4. Your Account

You authenticate via OAuth (GitHub or Google). You are responsible for maintaining the security of your account and any API keys generated through the Service. Gateway API keys (prefixed br_live_) are shown once at creation and cannot be retrieved afterward.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to circumvent rate limits or security controls
• Reverse-engineer, attack, or exploit the Service infrastructure
• Use the Service to generate content that violates provider terms
• Share or resell access to the Service without authorization

6. No Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THERE ARE NO SLAS, UPTIME GUARANTEES, OR SUPPORT COMMITMENTS.

7. Limitation of Liability

IN NO EVENT SHALL THE SERVICE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

8. Service Changes

The Service may be modified, suspended, or discontinued at any time without prior notice. Features may be added, changed, or removed. These Terms may be updated at any time; continued use constitutes acceptance of updated terms.

9. Termination

Your access may be suspended or terminated at any time for any reason, including violation of these Terms. Upon termination, your stored data (provider keys, usage history) will be deleted.

10. API Usage

API access is governed by rate limits and budget controls configured per API key. Exceeding these limits will result in 429 responses. Programmatic access must use the documented API endpoints; scraping the marketing site or dashboard is prohibited.

API keys are scoped to a tenant and may be further restricted by model access, budget limits, and permission sets. Keys that are compromised should be rotated immediately via the dashboard.

11. Data Processing

Request and response data is processed in transit to enable routing, cost tracking, and security scanning. Data handling is detailed in our Data Use Policy and Privacy Policy. By using the API, you consent to the data processing described in those documents.

12. Provider Pass-Through Liability

BrainstormRouter routes requests to third-party AI providers on your behalf. The Service is not responsible for the content, accuracy, or availability of responses from these providers. Each provider’s terms of service govern their portion of the interaction. The Service acts as a routing and governance layer, not as the AI model provider.

13. Intellectual Property

You retain all rights to inputs you send through the Service and outputs you receive. BrainstormRouter does not claim ownership of your prompts, responses, or derived content. The Service software, documentation, and branding are the intellectual property of the operator.

14. Export Compliance

You are responsible for ensuring your use of the Service complies with applicable export control laws and regulations, including U.S. EAR and EU dual-use regulations. Do not use the Service in sanctioned jurisdictions or for prohibited end-uses.
